POSH Calcutta HC Soumen Sarkar vs The State Of West Bengal judgment dt 16 September 2021.  This pertains to ICC constitution in which two members of the Governing Body of the college were nominated to enquire into the complaint lodged against an Associate Professor.  ICC was constituted in accordance with the resolution of the Governing Body.  Thereafter, ICC enquired into the complaint and the final order of the ICC was placed before the court.  The HC was of the opinion that since the petitioner had certain reservations with regard to members of the Governing Body being members of the ICC, HC, to dispel allegations of bias, directed the college to reconstitute ICC and no members of Governing Council to be part of ICC.  Accordingly, the present final report of ICC is set aside.
